Welcome to Swashi. These Terms of Service (“Terms”) govern your access to and use of the Swashi platform, applications, APIs, and services (collectively, the “Services”).
By accessing or using Swashi, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to use Swashi. By using the Services, you represent and warrant that you meet these requirements.
2. Description of Service
Swashi is an automation and AI-powered platform designed to assist users with content generation, data extraction, product analysis, and workflow automation.
Swashi does not sell products on your behalf and does not assume responsibility for your business operations, listings, or sales.
3. User Responsibilities
- You are solely responsible for the products, services, and content you create or sell
- You must comply with all applicable laws, regulations, and platform policies
- You are responsible for verifying the accuracy of AI-generated outputs
- You may not use Swashi for illegal, deceptive, or harmful activities
4. Usage Limits & Fair Use
Swashi applies fair usage limits across its scraping, automation, and AI generation endpoints to ensure system stability and equitable access for all users.
Excessive, abusive, or automated misuse may result in throttling, suspension, or termination of access without notice.
5. AI Output Disclaimer
Outputs generated by AI models may be inaccurate, incomplete, or outdated. Swashi provides AI-generated content “as is” without warranties of any kind.
You are responsible for reviewing, validating, and approving any AI-generated output before using it commercially or publicly.
6. API Keys & Security
You are responsible for maintaining the confidentiality of your account credentials and API keys. Any activity conducted through your account is your responsibility.
Swashi encrypts stored API keys but cannot be held liable for losses caused by compromised user credentials.
7. Payments & Subscriptions
Certain features of Swashi may require a paid subscription. Fees, billing cycles, and renewal terms are disclosed at the time of purchase.
All payments are non-refundable unless required by law or explicitly stated otherwise.
8. Intellectual Property
Swashi and its underlying technology, software, branding, and content are the exclusive property of Swashi.
You retain ownership of the content you submit and the outputs generated for you, subject to applicable third-party terms.
9. Termination
Swashi reserves the right to suspend or terminate access to the Services at any time for violations of these Terms or misuse of the platform.
10. Limitation of Liability
To the maximum extent permitted by law, Swashi shall not be liable for any indirect, incidental, consequential, or loss of profit damages arising from your use of the Services.
11. Indemnification
You agree to indemnify and hold harmless Swashi from any claims, damages, losses, or liabilities arising from your use of the Services or violation of these Terms.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
